By downloading, installing or using the DriveBy Android application ("App"), you agree to these Terms of Service. If you do not agree, do not install or use the App.
DriveBy is a personal profit calculator for couriers. The App reads numeric values (fee and distance) visible on the screen of certain delivery platform apps you have installed on your own device, calculates your estimated net profit using inputs you provided (vehicle fuel cost, wear cost), and displays the result on a floating bubble.

You are solely responsible for compliance with the Terms of Service of each delivery platform you work with. Some platforms restrict the use of "third-party tools" while you are working. Read your platform's contract. DriveBy provides only on-device calculation; how you choose to use that information during a shift is entirely your decision and your risk.
We make no representation about whether the use of DriveBy is permitted under the terms of any particular platform. If a platform takes action against your account because of how you used DriveBy, that is between you and the platform.
Subject to these Terms, we grant you a personal, non-exclusive, non-transferable, revocable licence to install and use the App on Android devices you own or control.

DriveBy is distributed as a direct download (APK) from https://driveby.dev - not through an app store - and is a paid app with a free trial. To use it you need either an active 14-day trial (with a payment card on file) or an active Premium subscription. There is no permanently free tier.
The 14-day trial requires you to add a payment card up front at checkout. Unless you cancel before it ends, it automatically converts to a paid subscription. We send an in-app reminder before the trial converts (in addition to any notice from our payment provider).
Premium (€5.99 / month or €49.99 / year - or the local equivalent, e.g. 24.99 zł / 199.99 zł in Poland; prices are subject to local currency conversion and tax) includes all features:
Subscriptions are sold and billed by our authorised reseller acting as Merchant of Record - Lemon Squeezy (the "Reseller"). The Reseller is the seller of record for your purchase and handles payment, invoicing, applicable VAT and refunds; your contract of sale for the subscription is with the Reseller. The price you pay is the localised price shown at checkout at the time of purchase. You can cancel at any time from the customer portal linked in the App and in your purchase-confirmation e-mail; cancelling stops the next renewal and you keep access until the end of the paid period. Refunds follow the Reseller's policy and any applicable mandatory consumer-protection law.
We do not separately offer refunds outside the Reseller's policy unless required by mandatory consumer-protection law.
Subscription identity. Your entitlement is tied to the e-mail address you use at checkout. To unlock the App you confirm that e-mail with a one-time code (a "magic link") - there are no passwords and no separate account. See the Privacy Policy for how this e-mail is processed.
Updates. Because the App is installed from our website rather than an app store, it checks driveby.dev for new versions and lets you download and install an updated installer file when one is available. From time to time an update may be required to keep using the App (for example, after a change on a delivery platform that older versions can no longer read); in that case the App will ask you to update before continuing.
DriveBy's calculations depend on:
Calculations are estimates. We make no warranty that any displayed profit number is exact. The App is provided "as-is" and "as-available", without any express or implied warranty, to the maximum extent permitted by applicable law. This does not affect any mandatory consumer rights you may have under Polish or EU law.
To the maximum extent permitted by law, our total aggregate liability to you arising out of or in connection with the App is limited to the amount you paid for the subscription (whether to us or to our Reseller) in the twelve (12) months preceding the event giving rise to the claim. If you have not paid anything (for example, during the free trial), that amount is zero.
We are not liable for:
Nothing in these Terms excludes liability for: (a) death or personal injury caused by negligence, (b) fraud or fraudulent misrepresentation, or (c) any other liability that cannot be excluded under applicable law.
You may stop using the App at any time by uninstalling it. We may terminate or suspend access to the App if you materially breach these Terms. Termination does not affect any rights or obligations that accrued before termination, nor any provisions that by their nature should survive termination (Sections 5, 6, 7, 8, 10).
The App's source code, design, brand, name, logos, and documentation are owned by DriveBy. The names "Glovo", "Uber Eats", "Bolt Food", "Wolt", "DoorDash" and similar marks belong to their respective owners and are used only descriptively to indicate compatibility - DriveBy is not endorsed by these companies.
These Terms are governed by Polish law, without regard to its conflict-of-laws principles. The competent court is the court of DriveBy's place of business in Poland, unless mandatory consumer-protection rules grant you a different forum.
We may update these Terms as the App evolves. The current version is always available at:

Material changes affecting your rights will be announced in-app at least 14 days before they take effect. Continued use of the App after a change constitutes acceptance.
